2. Definitions

ASTERIELLY DESIGNS (the Designer): Daniela Gutiérrez López, responsible for the digital products and personalized services offered on asteriellydesigns.com.

CLIENT: Any person who purchases digital products or requests personalized services through the Site.

​​​​Digital Products: Intangible designs and resources available on the Site, divided into:

• Premade book covers, graphics, videos: Designs that can be customized according to the CLIENT's needs.

• Downloadable Resources: Ready-to-use elements that require no editing, such as textures, illustrations, or mockups.

Personalized Services: Exclusive, made-to-order designs created specifically for the CLIENT, governed by a separate agreement.

License of Use: Permission granted to use the digital products within the limits established in these Terms.

Promotional Use: The right of ASTERIELLY DESIGNS to showcase completed designs, drafts and discarded concepts in its professional portfolio and other media channels.

3. Digital products

License of use

The purchase of a digital product grants the CLIENT a non-exclusive, non-transferable, and limited license for the uses described in its product description. Intellectual property rights are not transferred; only the right to use the product under the terms indicated in the specific license of each digital product.

Prohibitions

• Resale, redistribution, or modification of the digital products without prior authorization is not permitted.

• The use of our designs in artificial intelligence software for the purpose of generating derivative works or training is not permitted.

• You shall not continue a series or project based on the purchased designs without the express consent of Asterielly Designs.

Delivery

Digital products will be delivered to the email address provided by the CLIENT once payment has been confirmed.

Revisions

The included revisions are specified in each product description. Additional revisions are available starting at $600 MXN (the quote may vary depending on the complexity of the revision).​

Revision: Minor adjustments that do not alter the original design.

• Examples: color changes, typography, text size, or small visual details.

• Cost: Included up to the allowed number of revisions; additional ones are subject to extra charges.

Redesign: Significant modifications to the original design.

• Examples: complete change of style, composition, illustrations, or key elements.

• Cost: Considered a separate service and requires a new quote.

Final sales

All licenses for digital products are final sales. No returns or refunds are accepted.

4. Custom services

Requests and quotes

The Site serves only as an initial contact point to explore custom services. Each quote is provided individually and governed by a separate contract.

Listed services prices are subject to change at any time, and without prior notice. Quoted prices are valid for thirty (30) days and will be guaranteed only once the respective retainer has been covered.

5. Intellectual property

Digital products

Purchasing a digital product grants the CLIENT a non-exclusive, non-transferable, and limited license for the uses described in its product description. Intellectual property rights are not transferred; only the right to use the product as per the specific license.

Custom services

The license for deliverables resulting from custom services will be granted according to the terms outlined in the applicable contract.

Images and elements used in our designs

All images included in our designs come with standard commercial licenses and are not exclusive (unless otherwise is indicated). If the CLIENT requires an extended license, they must cover the additional cost.

If the Client provides an image, they retain the rights to that image only, and not the whole design. By providing an image, the Client guarantees the they’ve obtain the correct rights and permissions for Asterielly Designs to use it and modify it as needed for the design. Asterielly Designs will not be liable from any and all copyright and permission infringement action resulting from Client provided materials.

Asterielly Designs Resources

The Client understands that any stock, assets or images from ASTERIELLY DESIGNS collection or created by ASTERIELLY DESIGNS, are non-exclusive and ASTERIELLY DESIGNS retains all copyright and license to use as they need in any project.

The CLIENT can obtain a license for ASTERIELLY DESIGNS assets used in their cover by contacting them, understanding that this is subjected to a separate agreement and fee.

Attribution and promotional use

Attribution: The CLIENT is required to attribute cover design to ASTERIELLY DESIGNS in the copyright page of the associated work of each cover, as well​

Promotional Use: ASTERIELLY DESIGNS may include the final designs, drafts, and discarded concepts in her professional portfolio and promotional platforms, while maintaining CLIENT confidentiality.

AI Usage: AI imagery is not used by Asterielly Designs.

Even though there are occasional mistakes and reputable websites neglect to appropriately tag AI, we are committed to being diligent in our efforts to prevent such errors. Should we mistakenly use an artificially generated image in our design, we will promptly correct it by removing it from the cover. Accidents are part of being human, but we are committed to making things right if they occur. 

The Client, cannot feed any of Asterielly Designs work, into any form of AI. This includes, using AI, to modify, replicate, replace, or alter in any way the Designers files. This includes, and is not limited to, concepts, drafts, revisions, or final files.

If the client is found to have used AI on the Designers files, the Designer is entitled to compensation up to the value of 100%.

6. CODE OF FAIR PRACTICE:

ASTERIELLY DESIGNS acknowledges that to the best of their knowledge, the work prepared is an original creation and has not been previously published, and/or consent to use has been obtained. The work prepared contains no scandalous, libelous, or unlawful matter. The Client and/or others may not use ASTERIELLY DESIGNS products in any way that may infringe upon the rights of others.

7. Refunds

Due to the digital nature of our products and services, refunds are not applicable.

8. Confidentiality

All information exchanged between ASTERIELLY DESIGNS and the CLIENT shall be treated as confidential and used solely for the purposes of the project. Neither party may disclose this information without prior written consent. This obligation remains in effect even after the end of the business relationship.

9. Invoicing

The CLIENT may request an invoice by sending their tax information to asteriellydesigns@gmail.com. It will be issued within 48 business hours, in accordance with Mexican tax regulations.

10. Final provisions

Governing Law: These Terms are governed by Mexican law. Any dispute shall be submitted to the competent courts located in Michoacán, Mexico, with express waiver of any other jurisdiction.

Updates: These Terms may be modified from time to time. The current version will always be available on the Site. It's the CLIENT responsibility to check our website periodically for changes.

Continued use or access to our website or any service offered following the posting of any changes to these Terms of Service constitutes acceptance of those changes.

Acception of terms: ​ Both ASTERIELLY DESIGNS and CLIENT acknowledge acceptance of these terms. By acknowledging this contract, the CLIENT agrees to hold ASTERIELLY DESIGNS entirely free from any liability, including financial.​​​
